Biden Administration Covers Gender Confusion in New Title IX Rules

On Friday morning, the Biden administration finalized sweeping changes to Title IX, expanding federal legal protection against sex and gender discrimination in schools.

Title IX is a federal law that prohibits discrimination on the basis of sex in any education program or activity receiving federal financial assistance. This applies to a wide range of institutions, including public elementary and secondary schools, universities, colleges, vocational schools, libraries, museums, education agencies and private schools that receive federal financial assistance from the U.S. Department of Education.

The rules, which take effect on August 1st, require schools to respond quickly to sex and gender discrimination, expand LGBTQ rights, and give those who self-identify as “victims” more power in sexual abuse and discrimination claims.

U.S. Representative Mary Miller (R-Taylorville) released the following statement in response to this foolishness:

The Biden administration’s Title IX rule erases the definition of ‘sex’ and creates an imaginary ‘gender-identity’ category that ignores the biological differences between male and female. 

The radical redefinition of gender by Joe Biden will force young girls to share bathrooms and locker rooms with men, which will enable sexual predators to prey upon our daughters and granddaughters. Title IX exists to protect women and girls from discrimination and abuse, but by allowing men to redefine themselves as women, Joe Biden is permanently erasing protections for our daughters.

I will be introducing the legislation required to block Joe Biden from erasing Title IX protections for our girls, and I urge parents across the country to stand up and defend your daughters from this radical attempt by Biden to force men into girls’ spaces.

Former Education Secretary Betsy DeVos also slammed the new Title IX rules, saying the statute created to protect women would now be used to “harm” them. According to an article published by the Washington Examiner, she said,

“I never thought I’d see the day where Title IX would be used to harm women, but sadly, that day has come,” DeVos, who ushered through the Education Department’s 2020 rulemaking on Title IX, said in a statement. “The Biden Administration’s radical rewrite of Title IX guts the half century of protections and opportunities for women and callously replaces them with radical gender theory, as Biden’s far-left political base demanded.”

The Independent Women’s Form (IWF) issued a press release condemning this action by the Biden Administration, saying that it

…unilaterally rewrites the landmark sex equality law and undermines women’s rights, free speech, and due process. This new Omnibus Rule, which governs all aspects of the educational experience, turns Title IX on its head through extra-statutory regulations that require schools to allow males to self-identify into women’s spaces, opportunities, and athletics.

Their press release continues by lamenting the radical move. Jennifer C. Braceras, vice president for legal affairs at IWF and founder of the Independent Women’s Law Center (IWLC) laments the radical regulation, saying,

Taking opportunities from women and giving them to men doesn’t enforce Title IX, it violates it. That was true before the Administration dropped this rule, and it is still true today.

The Department of Education can’t just rewrite the statute by administrative fiat. We are confident the courts will remind the Department of this basic principle and strike down this unlawful rule.

According to the IWLC, polling suggests that “69% of Americans believe athletes should play on teams that correspond with their biological sex.”

Under the guise of protecting “civil rights,” the Biden administration is acting unilaterally, pandering to the far-left wing of the political spectrum while continuing the Obama-Biden promise of fundamentally transforming the country. To this point, Jennifer Sey, the Founder & CEO of XX-XY Athletics rightly decries the revisions in this Tweet of Friday, saying that they “are eliminating sex-based categories and distinctions…” Her is the entirety of her message:

Bottom line: These new rules will force government schools and any entity receiving federal financial assistance nationwide to bow before socially constructed “gender identities” and sexual perversions that now dominate the “education” system.

The rules may also be used to overturn state laws banning males in girls’ sports.
